These Terms of Service ("Terms") govern your access to and use of the With Him Healing website, located at withhimhealing.com, and everything offered on it (the "Service"), including the free books, Bible studies, and interactive workbooks. "With Him Healing," "we," "us," and "our" refer to With Him Healing. By agreeing to these Terms when you enter the site, or by otherwise using the Service, you agree to be bound by these Terms.

1. Everything Is Free

Everything on With Him Healing is offered completely free of charge. There are no accounts to create, no memberships, no subscriptions, no paid tiers, no fees, and nothing to buy. We do not sell anything, we do not accept payments, and we do not ask for donations. The books and studies are given freely, as a gift, so that what blessed us in the writing might bless you in the reading.

2. Eligibility

There is no minimum age requirement to use the Service. If you are using the Service on behalf of a minor or as a minor, you represent that you have the appropriate permission or capacity to enter into these Terms.

3. The Service

With Him Healing offers faith-based books, Bible studies, and related materials. This includes books you can read online, and interactive Bible study workbooks you can read, write in, and print.

The Service consists of devotional and educational materials. It is not a substitute for professional medical, mental-health, legal, or financial advice, and it is not a church, counseling practice, or healthcare provider. We do not guarantee any particular spiritual, emotional, physical, or personal outcome from use of the Service.

4. Acceptable Use

When using the Service, you agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms;
  • Attempt to gain unauthorized access to any part of the Service or related systems;
  • Sell, resell, sublicense, or redistribute Service content, including the books and workbooks, for commercial purposes. You are welcome to read, print, and share the materials freely for personal, family, and group study;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Use automated means (bots, scrapers) to access the Service without our prior written consent;
  • Misrepresent your identity when contacting us;
  • Send us content that is abusive, harassing, hateful, or that violates the rights of others.

5. Third-Party Services and Links

The Service may include links to third-party websites, such as Bible resources, and uses a third-party provider, Tally, for our contact form. We are not responsible for the accuracy, legality, or content of third-party websites or services, and your interactions with those third parties are solely between you and that third party.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any particular outcome will result from your use of the Service.

7. Limitation of Liability

To the fullest extent permitted by law, With Him Healing and its founders, volunteers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising out of or related to your use of, or inability to use, the Service. Because the Service is provided entirely free of charge, our total liability for any claim arising from these Terms or the Service shall not exceed one hundred dollars ($100).

8. Changes to These Terms

We may update these Terms at any time, at our sole discretion and without prior notice. Any changes take effect as soon as they are posted on this page, and the "Last Updated" date above will be revised. Your continued use of the Service after changes are posted means you accept the updated these Terms. We encourage you to review this page from time to time.

9. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles.

10. Binding Arbitration Agreement

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

10.1 Agreement to Arbitrate.

You and With Him Healing agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or your relationship with With Him Healing (whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and whether arising before or after the date you agreed to these Terms) shall be resolved exclusively through final and binding arbitration, rather than in court, except as set forth in Section 10.6 below.

10.2 Arbitration Rules and Administration.

The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, to the extent those rules are consistent with this Section. The AAA's rules are available at www.adr.org or by calling 1-800-778-7879. The arbitration will be conducted by a single, neutral arbitrator. The arbitrator, and not any federal, state, or local court, shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or part of this agreement is void or voidable.

10.3 Location and Procedure.

Unless you and With Him Healing agree otherwise, the arbitration will be conducted in the county in Texas where With Him Healing is based, or, at your election, by telephone or videoconference. If your claim is for $10,000 or less, you may choose whether the arbitration will be conducted solely on the basis of documents submitted to the arbitrator, through a telephonic or video hearing, or by an in-person hearing as established by the AAA rules. If your claim exceeds $10,000, the right to a hearing will be determined by the AAA rules.

10.4 Class Action and Jury Trial Waiver.

YOU AND WITH HIM HEALING AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

Unless both you and With Him Healing agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. If a court decides that this class action waiver is unenforceable as to a particular claim or request for relief, that claim or request must be brought in court and severed from any arbitration. YOU AND WITH HIM HEALING ALSO WAIVE ANY RIGHT TO A JURY TRIAL to the fullest extent permitted by law.

10.5 Arbitration Costs.

Payment of all filing, administration, and arbitrator fees will be governed by the AAA's Consumer Arbitration Rules. Where consistent with those rules, With Him Healing will pay costs and fees to the extent required to make this arbitration agreement enforceable. Each party will bear its own attorneys' fees and costs unless the arbitrator determines that a claim was frivolous, in which case the arbitrator may award fees consistent with applicable law.

10.6 Exceptions to Arbitration.

Notwithstanding the foregoing, either party may: (a) bring an individual action in small claims court for disputes within that court's jurisdiction, in lieu of arbitration; and (b) seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property or confidentiality obligations, pending completion of arbitration.

10.7 Opt-Out Right.

You may opt out of this arbitration agreement by sending written notice through our contact form within thirty (30) days of the date you first agree to these Terms. Your notice must include your name, your email address, and a clear statement that you wish to opt out of this arbitration agreement. If you opt out, neither you nor With Him Healing will be required to arbitrate, but all other provisions of these Terms, including Section 9 (Governing Law), will continue to apply, and disputes will be resolved in the state or federal courts located in Texas.

10.8 Severability.

If any portion of this arbitration agreement is found to be unenforceable or unlawful for any reason, that portion will be severed, and the remainder of the arbitration agreement will continue to be enforceable. If a court finds that the class action waiver in Section 10.4 is unenforceable as to a particular claim, that claim (and only that claim) must be brought in court and any other claims remain subject to arbitration.

10.9 Survival.

This arbitration agreement survives any termination of these Terms and any end to your use of the Service.
